After a federal arrest in Miami
A person arrested on federal charges is brought before a U.S. magistrate judge or district judge for an initial appearance. The court decides whether the person is released on bond or remanded to the custody of the U.S. Marshals Service to await trial.
If the government asks to hold the person, the court holds a detention hearing, generally at the first appearance unless one side asks for a short continuance. The judge considers the charge, the weight of the evidence, the person’s history and community ties, and any danger to others.
